»Extra-Legal Oral Explanations of the Criminal Judgement« »Extra-legal« denotes three different kinds of statements given by criminal judges during the oral pronouncement of judgment: first, moral explanations, in particular moral blame of the defendant; second, the use of vivid language; and third, explanations that thwart the operative part of the judgment. The work examines the admissibility of extra-legal elements and discusses legal nature and functions of the oral pronouncement of judgment, which is partly considered as a »free space« for the judge.
